Terms of Use

1. Agreement

These Terms of Use (“Terms”) govern access to and use of the CrewPilot website and software service (collectively, the “Service”) offered by Pascal Blue, a Sole proprietorship in India. By registering, accessing, or using the Service, these Terms are accepted on behalf of the individual and, where applicable, the organization represented. If the Terms are not accepted, the Service must not be used.

2. Eligibility & accounts

Users must be legally able to enter a binding contract in India (or in the applicable country if a higher minimum age applies). Accuracy of registration information, confidentiality of credentials, and all activity under each account are the responsibility of the account holder. Unauthorized use should be reported promptly.

3. The Service

CrewPilot provides tools for teams to manage operational workflows (such as tasks, assets, incidents, communication, and related features). Features may change. Parts of the Service may be modified, suspended, or discontinued with reasonable notice where practicable, especially for material changes affecting paid customers.

4. Customer data & privacy

Rights to data submitted by the customer remain with the customer. A licence is granted to host, process, back up, and display that data solely to provide and improve the Service, enforce security, and comply with law. Handling of personal data is described in the Privacy Policy. The customer represents that necessary rights and consents exist to submit personal data about end users or contacts into the Service.

5. Acceptable use

The following are prohibited:

  • Violating applicable law or third-party rights;
  • Uploading malware, probing or attacking systems, or circumventing security or access limits;
  • Scraping, reselling, or reverse engineering the Service except where mandatory law allows;
  • Using the Service for unsolicited bulk communications or harassment;
  • Misrepresenting identity or affiliation, or using the Service for unlawful discrimination or harm.

Violations may be investigated and access suspended or terminated.

6. Plans, fees & taxes

Some features may require a paid subscription. Fees, billing cycles, and taxes (including applicable GST in India, where relevant) are shown at checkout or in the order summary. Unless stated otherwise, fees are non-refundable except as required by law or as expressly agreed in writing. Non-payment may result in downgrade or suspension.

7. Cancellations & refunds

Use of the Service may be stopped at any time. For subscriptions, cancellation stops future renewals; access typically continues until the end of the current billing period unless specified otherwise. Refund eligibility follows the terms shown at purchase and applicable consumer protection laws in India. Chargebacks should follow good-faith contact with support; unjustified chargebacks may be disputed.

8. Intellectual property

The Service, branding, and related materials are owned by Pascal Blue and licensors, excluding customer content. A limited, non-exclusive, non-transferable licence applies during subscription or trial. Feedback may be used without obligation.

9. Third-party services

The Service may integrate third-party APIs, maps, payment gateways, or identity providers. Their terms and privacy policies govern those interactions. Pascal Blue is not responsible for third-party services it does not control.

10. Warranty disclaimer

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, implied warranties of merchantability, fitness for a particular purpose, and non-infringement are disclaimed. Uninterrupted or error-free operation is not warranted, nor that the Service meets every operational or regulatory requirement of a particular industry—customers remain responsible for their own compliance programmes.

11. Limitation of liability

To the maximum extent permitted by applicable law in India, Pascal Blue and its proprietor will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from the Service. Aggregate liability for claims relating to the Service in any twelve-month period is limited to the greater of (a) fees paid for the Service in that period or (b) Indian Rupees five thousand (₹5,000), except where law forbids such a cap (e.g. death, personal injury, fraud, or wilful misconduct).

12. Indemnity

The customer will defend and indemnify Pascal Blue against third-party claims and reasonable costs arising from customer content, breach of these Terms, or misuse of the Service, except to the extent caused by wilful misconduct by Pascal Blue.

13. Termination

Accounts may be closed where the product allows, or use may cease. Access may be suspended or terminated for breach, risk, legal requirement, or non-payment. Provisions that by nature survive (e.g. liability limits, indemnity, governing law) remain in effect after termination.

14. Governing law & disputes

These Terms are governed by the laws of the Republic of India. Subject to mandatory consumer protections, courts at Kolkata, West Bengal have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service, unless otherwise agreed in a signed writing.

15. Miscellaneous

If a provision is unenforceable, the remainder remains in effect. Failure to enforce a provision is not a waiver. Customers may not assign these Terms without consent; Pascal Blue may assign in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any order form or enterprise agreement, form the entire agreement on their subject matter.
